MATERNITY PAY: THE NEW RULE FROM THE SUPERIOR COURT OF JUSTICE AND ITS IMPACTS ON GRANTING THE BENEFIT

Abstract

This article analyzes maternity leave pay in Brazil, focusing on the interpretation of the Supreme Federal Court (STF) in Direct Action of Unconstitutionality (ADI) 2.110, which questioned the requirement of differentiated contribution periods for granting the benefit. The decision declared unconstitutional the differentiation of minimum contribution periods between categories of insured women, consolidating the understanding that maternity leave pay is a fundamental right to protect motherhood, not conditioned by criteria that restrict access for women in vulnerable situations. In this context, the research problem arises in the form of the following question: how does the decision in ADI 2.110 contribute to the social security inclusion of women and to the realization of constitutional rights related to motherhood? The research adopts a qualitative methodology, based on bibliographic review and jurisprudential analysis, including doctrines, academic articles, and judicial decisions. The objectives of the study were: general – to analyze the effects of the STF decision in ADI 2.110 on the granting of maternity leave pay; Specific objectives – (1) to understand the constitutional basis of the decision; (2) to identify the legal impacts of the declaration of unconstitutionality of the differentiated grace period; (3) to assess the social and practical impacts for women in vulnerable situations; and (4) to compare the jurisprudential evolution between ADI 2.110 and subsequent decisions, such as RE 576.967/PR. It is concluded that ADI 2.110 represents a legal and social milestone, consolidating maternity pay as an instrument of comprehensive protection for motherhood and female citizenship.
