THE SLOWNESS OF THE JUDICIARY IN DEALING WITH CLAIMS RELATED TO THE JUDICIALIZATION OF HEALTH

Abstract

This article examines the delays of the Brazilian Judiciary in cases involving the judicialization of healthcare, addressing the factors that drive individuals to seek judicial enforcement of the right to health and the challenges faced in ensuring its effectiveness. The starting point is the premise that access to healthcare is a fundamental right, enshrined in the 1988 Federal Constitution and in international treaties ratified by Brazil. However, the structural inefficiency of the healthcare system and social inequality lead a significant portion of the population to turn to the Judiciary as a last resort. The research considers decisions of the Federal Supreme Court, statistical data from the National Council of Justice, and legal norms, showing that judicialization, although necessary, has created an overload on the judicial system and an imbalance in the formulation of public policies. As an alternative, the article highlights the importance of coordination among the branches of government, the strengthening of public health policies, the use of technology, self-composition mechanisms, and interdisciplinary training as strategies to promote faster and more equitable access to healthcare. Finally, it concludes that the realization of this right requires integrated and cooperative solutions among the Judiciary, the Executive, and civil society.
